Apple is currently being investigated by the Competition Commission of India after a customer complained to the organization under Section 4 of the Competition Act 2002. While this might be some bad news for Apple who might have to answer to Commission, it's actually a ridiculous complaint and the reporting by PTI is hilarious and innaccurate.

Here is the complaint according to PTI

Apple is curbing the customer's choice by limiting the availability of iPhones and iPads in India to a limited number of service providers, besides its signature stores.

A senior CCI official who spoke to� PTI said that

"The complainant has also alleged that a user can only download software from the i-store and the others are not recognised by the device,"

The note also says

Besides, Apple phones could only be serviced in Apple centres, which in turn charge high rates for servicing.

Lets get some basic facts right !

  • Apple does not operate any stores in India. Apple only imports the products and supplies them to the distributors who then supply it to resellers / retailers.
  • iStore by Reliance Digital , Imagine Store (RSG Infotech) which also operates under Ample India brand , Croma are examples of resellers
  • Airtel is India's largest private mobile operator but Aircel is a relatively smaller operator.� Both have a large subscriber base. I would see a reason to complain if the iPhone 4 was launched on say Uninor or Videocon which i'm sure would never happen.
  • The reason according to our sources as to why Apple went with Airtel and Aircel is because both have 3G licenses in 13 circles.
  • BSNL which is a PAN-India operator tied up with Apple to offer dedicated plans for the iPad when it was launched in January this year.
  • The iPhone 3G and 3GS which was sold through Airtel and Vodafone until last year was locked to the networks.
  • The iPhone 4 is sold unlocked in India. You can buy it from a reseller , Airtel or Aircel without having to enter into a contract.
  • The iPad and iPad 2 is also sold unlocked ( 3G models)

There is a huge demand world wide for the iPad2. Stocks are low not only in India but also worldwide. I had to run to 6 stores before I got my iPad2 when in the US last month. But still stocks are lower in India due to lower demand compared to other larger markets.

  • Apple has an iTunes app store for India where you can use your credit card to purchase Applications. You can also download free applications from the AppStore.
  • The iTunes Music store does not work in India due to licensing / copyright issues.

Complaining that you can download apps for the iPhone only from the App Store and that other ways don't work is so silly. It's like buying a petrol car and complaining that it wont run on Diesel. Each and every mobile platform has an app store now. Nokia OVI Store,� Android Market and BlackBerry AppWorld work in a similar manner. Side loading is possible in most platforms but can void warranty. Yes, the iPhone Platform is restricted but that's how it is built and it's one of the reasons for it's success.

The complaint about service centers is again lame. Take any piece of electronic equipment and especially phones. The moment you take the unauthorized route to get it fixed, you void your warranty. Apple service centers are one of the best in the world. In India , they have Apple Authorized Service centers. I� have had my mac's battery replaced for free. Recently, my iPhone was disabled and I was at a Imagine store at Bangalore. They checked my iPhone 4 for free and told me the only solution was to restore it or sync it to my authorized iTunes computer. I chose not to restore it and came back home and fixed it myself. But still they at least guided me without charging anything. But i have heard from some sources that for some issues they ship phones to Singapore for servicing.

Lets see what the Section 4 of the Competition Act talks about

In the past , I have been known to criticize Apple for not bringing the iPhone to India and not taking India seriously. For once I feel Apple is taking India seriously because all of it's latest products including the iPhone 4 and iPad 2 are available in the market. Apple India has also done a decent job with pricing recently unlike few years back when only the really rich could afford to buy Apple stuff in India.

The Commission is due to take up the matter for consideration by the end of this week and it will be certainly interesting to see how the case shapes up !

Back at MWC, HTC officially announced their first ever Android tablet which is known as HTC Flyer. HTC Flyer is an amazing tablet and I recently reviewed it and told you that it's one of the best Android tablets. Recently, we showed you first shot of HTC's upcoming�Android tablet which will be HTC first ever Honeycomb tablet and it will be running on Honeycomb along with Sense UI. We heard that HTC will start Puccini mass production in June and now it looks like the official announcement is around the corner. HTC is now holding an event on June 27 in London and in past, HTC have announced products like HTC Hero, Sense UI, Desire Z and Desire HD in London, so you can expect something big. Now it's time to guess, rumor has it that HTC will be officially announcing HTC Puccini at this event as we heard it will be out around summer holiday time. But my guess is that if they are launching Puccini, then I think they will launch the international version, not the AT&T one.

So folks, do you think HTC is really launching Puccini on June 27?

Does the name Richard Garfield ring a bell? No? Well, the man is responsible for creating both Magic: The Gathering, the Star Wars Trading Card Game and a ridiculous list of other less notable (but still fantastic) collectable card games and board games. Better yet, he's lending his lifetime of incredible expertise to co-creating a brand new strategy-based iOS card game called Kard Combat.

Kard Combat features a 33 battle campaign that sounds a little similar to how Duels of the Planeswalkers works in addition to single duel mode. Initially there's going to be "over 100" cards, along with "four unique mages to master." I however have a feeling that the free online multiplayer mode is going to be the star of the show.

As someone who has spent more of my life playing Magic than not playing Magic, seeing Richard Garfield involved in an iOS game is fantastic news. There's a ton of M:TG-like games on the App Store, but to someone who is familiar with lots of collectable card games, these always seem to feel half-baked and like they're borrowing mechanics from existing card games. Also, the fast development cycles and low price points of iOS games don't exactly allow for extensive testing to make sure these game are balanced as masterfully as something like Magic: The Gathering.

Like many online free to play games, Kard Combat is currently available in Canada before being unleashed to other regions. If you're a "Canadian" or an actual Canadian, give it a try. I'll be playing some battles today in preparation for a review whenever it actually goes online in the rest of the world. I've got my fingers crossed that Richard Garfield being onboard allows Kard Combat to side-step the issues other similar games have, it sure would be disappointing if it didn't.

Want to know why you're not seeing a lot of Take-Two label games on the App Store? That answer resides in a new Forbes interview with CEO Strauss Zelnick. When the conversation turned towards iPad and iPod games, the business-first-man whipped out the phrase "economically meaningful." When used in a negative light like he did in the talk, it means, "not making the kind of money we want." In short: the cold reality of business is why.

"We've tried a bunch a things. We tried Chinatown Wars [$9.99 / HD] for the iPhone, and we're thrilled that we did it, and it was creatively successful. At the price point for which we can sell on the iPhone, it is not going to be economically meaningful," he said.

To keep this in focus, Chinatown Wars started out as a Rockstar Leeds Nintendo DS project. The App Store version is a port with a few bells and whistles. The original DS title did not perform up to expectations, either.

"At the end of the day, we are interested in creating economic value, and what we intend to do is make something and sell it to millions and millions of people, and sell it at a high price. You don't want to spend lots and lots of money to make something you are going to sell to a small amount of people at a low price."

So, smart � thus, cold and non-consumer facing � business is, part of what's gumming up the Take-Two / App Store works. Pricing specifically was touched on. Zelnick,�naturally, favors boosted prices. When pressed, he seemed opened to the idea of a $20, $30, $40 tablet games � but provided that said game brings a "robust and engaging" experience.

"I don't see why not. Tablets are ubiquitous. And tablets are a great game platform. And it's the right sized screen. And you use the tablet to have an engaging experience. So if all of that's true, I don't see why we wouldn't be able to sell a robust product for the same price point. The reason the price point is currently lower for an iPhone app is it is used for five minutes, and not for a hundred hours," Zelnick said.

There's no little pretty bow to wrap this up in � Zelnick was non-committal about the App Store as a whole. The thing is, though, is that Take-Two exists to make money and there's no doubt at all that the App Store can provide in this arena. The question we're asking now is if Take-Two will scale back experiences to cater to lower prices or if it actually does plan to charge premiums for console-like titles.
